Privacy Policy

Privacy is very important to us. We understand that privacy is also very important to you. TNI wants you to be familiar with how we collect, protect, use, and disclose information through our U.S. website (“site”). That is why we post this, our Privacy Statement.

This website and this Privacy Statement are intended for a U.S. audience. This Privacy Statement does not apply to any other TNI websites.

This Privacy Statement was last revised on August 22, 2016. We may change this Privacy Statement at any time and for any reason. We encourage you to review this Privacy Statement each time you visit our U.S. website.

By using this site, you agree to the terms of the most recent version of our Privacy Statement. You also agree to our Terms of Use: www.tni-medical.com/tc. To understand the general rules about your use of this website, please read them as well. Except as written in any other disclaimers, policies, terms of use, or other notices on this site, this Privacy Statement and the Terms of Use are the complete agreement between you and TNI with respect to your use of this website. You may be subject to additional terms that may apply by following a link from this website.

If you have questions or concerns about this Privacy Policy, please contact us by sending an email to info@tni-medical.de.

The information we receive, and how we use it, depends on what you do when visiting our site. We collect and use your personal information and your non-personal information (information that is not identifiable to you personally) differently.

Non-personal information is information we collect through this website that does not identify you as an individual. It may include information such as the following:

·         your computer type (Windows or Macintosh)

·         the type of web browser software you use (for example, Internet Explorer)

·         your screen resolution

·         the name of the domain from which you access the Internet

·         the Internet address of the website from which you linked to our website

·         your Media Access Control (“MAC”) address

·         the date and time you access our website

·         which pages you have visited on our website

·         the links on which you click

·         personal information that has been made non-personal or de-identified (i.e., information that no longer reflects or refers to an individually identifiable user)

·         If you access the Site through a mobile device, we may collect similar information, such as your device type and identifier.

·         Note to U.S. healthcare providers: please see “HOW DOES TNI KEEP AND USE PERSONAL INFORMATION?” described below.

If you only read or download information on our site, we do not collect or learn your name, e-mail address, home address, or other personal information about you.

Our web pages contain electronic images (called a "single-pixel gif" or "web beacon") that allow us to count page views. In general, any electronic image viewed as part of a web page, can act as a web beacon. Web beacons are typically very small, 1 by 1 pixel size, banner-like files, but their presence can be easily seen within Internet Explorer, for example, by clicking on "View" and then on "Source." Web beacons are kept small to spare valuable space on the computer screen that is better used to display helpful content. We also may include web beacons in HTML-formatted newsletters containing graphics that we send to opt-in subscribers in order to count how many newsletters have been read. Our web beacons do not collect, gather, monitor, or share any personal information about our website visitors. They are just the technique we use to compile our anonymous, aggregated statistics about website usage.

Because non-personal information cannot identify you or be tied to you in any way, there are no restrictions on the ways that we can use or share it. We are always looking for ways to serve you better and improve this site. We use non-personal information from you to help us make this site more useful to visitors. We also use non-personal information for other business purposes. For example, we may use non-personal information or aggregate non-personal information to do: research and measurement, including measurements of the effectiveness of TNI’s services; dynamic content generation on this site or in newsletters; statistical monitoring of how many people are using this site; assessments of the popularity of certain site content; facilitation of a user's log-in; and navigation assistance and time session measurements, among other possible uses.

Personal information is information we collect through this website that we can use to specifically identify you, such as your:

 ·         name

·         telephone number

·         e-mail address

·         IP (Internet Protocol) address when such address is associated with a specific user

·         medical device serial number

·         personal health information

·         date of birth

·         for U.S. healthcare providers, a National Provider Identifier# (NPI) and/or a state license number

In some places on this website you may have the opportunity to send us personal information about yourself, to elect to receive particular information, or to participate in an activity. For example, you may fill out a registration form, a survey, or an e-mail form and you may elect to receive educational material about our products and therapies. You will be informed what information is required and what information is optional to take advantage of these offerings.

We may keep and use personal information we collect from you through this site to provide you with access to this site. In addition, we may keep and use your personal information:

·         to respond to your requests

·         to personalize your access to our website, such as by telling you about new features that may be of interest to you

·         to develop records, including records of your personal information

·         to contact you with information that might be of interest to you, including, for example, information about clinical trials and about products and services of ours and of others

·         for analytical purposes and to research, develop and improve programs, products, services and content

·         for U.S. healthcare providers, to link your name, National Provider Identifier (NPI), state license number, and/or your IP address to web pages you visit, for compliance, marketing, and sales activities

·         to remove your personal identifiers (your name, e-mail address, social security number, etc.). In this case, you would no longer be identified as a single unique individual. Once we have de-identified information, it is non-personal information and we may treat it like other non-personal information.

·         to enforce this Privacy Statement and other rules about your use of this website

·         to protect our rights, property, or safety, or that of our customers

·         to protect someone's health, safety or welfare

·         to comply with a law or regulation, court order or other legal process

Subject to the terms of our Privacy Statement, we may transfer personal information as an asset in connection with a proposed or actual merger or sale of TNI (including any transfers made as part of an insolvency or bankruptcy proceeding) involving all or part of our business or as part of a corporate reorganization, stock sale, or other change in control of TNI.

If you provide us personal information about others, or if others give us your information, we will use that information only for the specific reason for which it was provided to us.

TNI will not share your personal information collected from this website with an unrelated third-party without your permission, except as otherwise provided in this Privacy Statement.

We may be legally compelled to release your personal information in response to a court order, subpoena, search warrant, law or regulation. We may cooperate with law enforcement authorities in investigating and prosecuting website visitors who violate our rules or engage in behavior that is harmful to other visitors or unlawful.

We may disclose your personal information to third parties if we feel that the disclosure is necessary to:

·         enforce this Privacy Statement and the other rules about your use of this website

·         protect our rights or property

·         protect someone's health, safety or welfare

·         comply with a law or regulation, court order or other legal process

Please note: In addition to the ways that we may keep, disclose, and use information described in this Privacy Statement, we also may keep, disclose, and use personally identifiable information that you give us through this website in ways that we believe are consistent with FDA and other governmental guidance, directions, regulations, and laws.

We retain your personal information for the period necessary to fulfill the purposes outlined in this Privacy Statement, unless a longer retention period is required or allowed by law or to otherwise fulfill a legal obligation.

By using our site, or providing information to TNI, you understand and unambiguously consent to the collection, use, disclosure and retention of information in the United States and other countries and territories, for the purposes set forth in this Statement. You hereby consent to TNI’s collection, use, disclosure and retention of your personal data as described in this statement, including but not limited to the transfer of your personal data between TNI’s third parties, affiliates and subsidiaries. For further certainty, any consent relating to a right to transfer information referred to in this paragraph shall be deemed to include your consent to the transfer of the applicable personal data to a jurisdiction that may provide a different level of privacy protection than that available in in the U.S.

California law (the California Online Privacy Protection Act, “CalOPPA”) requires TNI to let you know how we respond to web browser "Do Not Track” (“DNT”) signals.  Because there currently is no industry or legal standard for recognizing or honoring DNT signals, and because TNI does not track the users of this web site over time and across third party sites to provide targeted advertising we do not honor Do Not Track requests at this time.

Unless we specifically request or invite it, we ask that you not send us, and you not disclose, any sensitive personal information (e.g., information related to racial or ethnic origin, political opinions, religious or other philosophical beliefs, health, sexual orientation or identity, criminal background or trade union membership) on or through our site or otherwise to us.

If we decide to make a significant change to our Privacy Statement, we will post a notice on the homepage of our website for a period of time after the change is made. Each time you visit our site, however, you should read our Privacy Statement and our Terms of Use, in case either or both have changed since your last visit.

If you communicate with us, and your communication requests a response from us, we will send you a response via e-mail. The e-mail response or confirmation may include your personal information, including personal information about your health, your name, address, etc. We cannot guarantee that our e-mails to you will be secure from unauthorized interception. Nor can we promise a timely reply. We anticipate that, on average, it will usually take about three days to furnish a response to you, but sometimes it may take longer, while at other times we may respond more quickly.

DO NOT USE THIS SITE IF YOU ARE DEALING WITH A MEDICAL EMERGENCY, OR YOU THNK YOU MAY BE.  Instead, call 911 or your own health care professional immediately.

We care about protecting the online privacy of children. We do not knowingly collect personal information (such as a child's name or e-mail address) from children under the age of 13. If you think that we have collected personal information from a child under the age of 13, please contact us at info@tni-medical.de. If we learn we have collected or received information from a child under 13, we will delete it.

Security is very important to us. We consider the protection of all personal information we receive from our website visitors and others as critical to our corporate mission. We also understand that security is important to you. We take reasonable steps to protect your personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction. We follow generally accepted standards to protect personal information submitted to us, both during transmission and once it is received. We incorporate into our web site and corporate operations reasonable and appropriate security standards to protect the personal information that we maintain.  You should keep in mind, however, that no Internet transmission is ever 100% secure or error-free, and that no security measure is perfect or impenetrable. In particular, e-mail sent to or from this site may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail
